I am in 6th year, PERM applied and it is in AUDIT -> options

Hi,

I am in 6th year of my H1B. My company applied my PERM before 365 days of completing my 6th year(including recapture time) and my 6th year will complete in 1st week of August.2012. My PERM applied on July.13.2011 and there is an AUDIT on my PERM in Sept end.2011.

Question:

1. What are the chances to get my AUDIT cleared on my PERM?. I know it depends on how it is been applied but I want to know what would be the success rate?.

2. I checked with my attorney whether can we apply a backup PERM but she says it is not required. If we want to go that route then its whole new process starting from scratch. Do you recommend/ suggest to apply a backup PERM incase the PERM applied got rejected/ declined?. Remember I am in 6th year already now.
