!!!Urgent!!! H4 petition questions

Hi,

Can anyone please tell me, whether I need to file a different petition for my wife H4.

My Scenarios is:

1. My H1b is approved currently.

2. She is in India and I am going to India to get married this month.

3. She has never been to US, so there is no COS for her case.

In this case can she go with me for a visa interview based on my H1 petition or does my employer need to file another seperate H4 petition for her?

Your case is very simple. Infact you are lucky. She needs to go for H4 stamping, not necessarily along with you. I suggest she goes alone first to stamping. She gets visa for whatever 3 yrs you got on H1b. once she comes here, she can be on that visa and no need for any H4 filing extension stuff.
