pinkslip-221g Posted November 6, 2011 Report Share Posted November 6, 2011 my 6th yr h1b expire sept 2012 and i have approximately 11 months stay out side us . h1b extension can be only before 6 months.so can my employer start perm now and h1b extension after few months.will it be accepted as perm applied before 365 days rule or should i get extension first then start the gc process to comply the 365 days rule? seniors/attornery pls help. thank you.
