I have joined Company B while transfer was pending and now got transfer approval for 1 year.(assuming I-140 would not have been revoked at the time of H1B transfer). Are there any other ways, apart from new PERM filling and approval as I do not have 365 days? While working for Company B, can the same company apply for new H1-B so that they get approval for 3 years based on previous employer I-140 and presenting SOW from another client. pontevecchio Posted October 28, 2011 Report Share Posted October 28, 2011 Aslong as the I-140 is not revoked you are entitled to three year H1 extensions and any previous extensions if the I-140 is revoked remain valid till expiry. Link to comment

Is it possible that same employer can file a H1-B Ammendment indicating that I will be working for a different client at different location and get an extension prior to the expiry of 6 months of i-94/petition? If you have an approved I-140 you can get extensions of H1 for up to 3 years beyond the initial 6 years. Once the I140 is revoked then existing H1 extensions based on the I-140 continue to exist. Future extensions are not possible on this basis. Link to comment
