My EB2 labor is approved and I am planning to apply 140. Since I already have an approved EB3 140 with my previous employer with priority date Nov 2007, I want to port my EB3 priority date and apply 485 concurrently. I want to know if my 140 + 485 application is query prone? Since my employer already got Ability to pay query, will I get same query? Most of EB3 to EB2 porting cases get query, are there chances or getting query for me? Is it worth waiting until USCIS responds to my employer response and then apply my 140 + 485? If I procrastinate my application, will dates in EB2 move back? Thanks. Link to comment
Belle Posted October 17, 2011 Report Share Posted October 17, 2011 I think you are working hard on jumping to conclusions. First, there is absolutely no evidence to suggest and concurrent filing would get any more scrutiny than a regular filing. Second, each I-140 is considered on its own merits. You don't know what kind of evidence was submitted with your friend filing - maybe the attorney forgot some documents. Link to comment
