Valid L2 Visa, and H4 is InProcess.

I haved changed from L1 to H1 status. Now my works status is H1. My wife H4 is In Process. Right now she is having L2 with valid visa stamping,which expires in 2012. Can she now go to India and come back to US on L2?

In case,if she got H4 while she is in India,how it will work.

If she travels she will need to come back on the H4 visa. her status is based on your status. She has lost L2 status. She can come back in H4 status after getting the H4 visa.

Thanks Dude. Her H4 is still in process. even should wait in India to get complete H4 status and after only return to US? Lets say she can go to India for 1 or 2 months. in this time period H4 is still in process.She should wait in India?

H4 is not a petition. She can get her H4 visa tomorrow if feasible and come over. The only requirement for the H4 visa is your valid H1 status with proof.
