My employer applied by GC, Labor is approved and I-140 is in process, still not approved(got REF) so what should I answer to below question Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services? thanks Share this post Link to post

Some one correct me but for form I140 it's title is actually "Immigrant Petition for an Alien Worker". @masdha I think you should mention that your employer filed your I140 and it is still in process. The attorney asked me to put the fact that "an i-140 based immigrant petition had been filed and approved via Ref #." My attorney works for Fragomen. Share this post Link to post

JoeF 7 Report post Posted October 6, 2011 I-485 is immigrant petition. Not any other. Wrong. The I-130 and I-140 are the immigrant petitions. If one of these is filed, the question has to be answered with "yes". I-485 is Adjustment of Status, something completely different. To get a GC, an I-485 isn't even needed, if the person does Consular Processing. But the immigrant petition is needed. Share this post Link to post

If you had not paid fees and booked your appointment use the new DS160 number. If you had already done so then contact the agency that facilitates visa appointment and get it updated. Also last year, my H1 transfer petition got approved by a new employer since I changed my decision I did not join them.
