All old pals like liondanny, olive, justicesid, bittoo, tanish, desiinvidesh, troubledvisa, newbie ( I can just remember these many usernames now).. Please post ur updates here.. Overview of my case - VI - 8th April 2011 New Delhi Embassy H1B Extension 221g green on day of Interview Submitted documents 3 times as requested ( end of April, end of May & end of June) Last week of July - employer got to know about case being sent back to USCIS USCIS website status changed on 11th Aug 2011 I finally got my passport back on 15th Sep & 2 days after this received a formal rejection letter (dated 27th July) Calling DOS after case has been sent back to USCIS is of no use I guess - Yesterday called DOS & the operator said that there is no case for you, its returned back to USCIS. 221g_Delay Posted September 28, 2011 Report Share Posted September 28, 2011 Hi All, Consulate: NewDelhi. DateOfInterview:10th June & 221g Green. DocsSubmission: 6th July. My employer wrote to delhi consulate to request expediting my case and yesterday, VFS delhi wrote back stating the case has been sent back to KCC. I haven't received any email notification yet by the consulate, also, when I call the VFS desk they still say admin processing? To move forward, How can we find the necessary basic info as in, The USCIS site still shows the old approved status, 1. What is the timeline before I should see the change at USCIS site? Is there any Ph# we can call to affirm if KCC/USCIS has the petition returned. 2. Can my employer file for a new H1B while my case is with or being/sent back to USCIS/ KCC? Why its better to withdraw the old petition when filing for a new H1B? 3. Do I need to go back to Delhi for stamping? How is Kolkatta compared with Delhi and Chennai consulate? Thanks.. When I sent mail to them asking my status, I got this reply that my case sent back to USCIS. This reply I got on September 14th 2011. Till now, either me or my employer got any msg from USCIS about their decision. Can you please give me some suggestion, what to do. U can keep checking on the USCIS website about the status as to when ur case reaches them. Also I believe employers / lawyers can contact the USCIS via phone to get an update. Regards, Tejal. olive1 Posted October 7, 2011 Report Share Posted October 7, 2011 @tejal: Basically it returns to same service center where you file your H1B/extension. Also I get know from senator's office as well. Right now I am not going for new employer or new H1B. Because if I moved to some one else there will be same situation for me. so I am waiting for any RFE or NOIR from service center. and finding new job from here is very tuff. Moreover most of them are not willing to file a new H1 when u are in India, coz they know that 221g is a major issue. So they are preferring if you were in the US. I am also waiting back to hear something from the respective service center. Meanwhile trying to look some jobs here to pass my time & keep myself busy. Link to comment

From last 1 and half month me and my employer didn't get any communication from USCIS. I sent mail again to VFS asking what is my status, then I got following in reply : "As per the US Embassy, since your case is no longer at their office, for further inquiries you/petitioner may wish to contact the approving USCIS office. Can someone please tell me where I have to contact as my passport is still with me? Link to comment
extreme_in Posted November 13, 2011 Report Share Posted November 13, 2011 Hi, Complete Background First Interview: May 4th - Got 221g Green form Documents Submitted – May 12th We contacted Senator office on Jun 6th asking for their help to get more information for our case. Jun 10th we received the reply from Senators office. Letter Stating - Your Peitioner does not appear to be able or willing to provide qualifying employment in US in accordance with appropriate laws and regulation. We submitted amended application to the USCIS on July 12th . We received the RFE from USCIS on July 18th where they want the evidence that employer-employee relationship will exist between the petitioner and beneficiary and you have the right to control the beneficiary’s work. We received the final approval from USICS Had the second interview on Aug 29th and we got the 221 g again stating that this case will be treated as new case (I guess becuase my peition number changed) . We have submitted all documents to the US Consulate again on Sept 1st . We have contacted the US Embassy for an update and learned that our case has been sent back to US for approval. Dept of State has sent the case back to USCIS as of September 29th. As of Oct 20th, My case is reaffirmed by USCIS. I have contacted US Embassy asking for next steps. I realy hope that I dont have to go for another interview but drop my passport for Visa Stamping. I got some information from US Consulate that PIMS is yet not updated with my status and to wait till that happen and that was 2 weeks back. No information since then. Praying continuess.... Anyone got the reaffirmation and did they have to go to US Embassy? Thanks E Link to comment

You can even open account on their dashboard and you can get aotumatic emails if there is a change in your status. We use to call alot that at one point phone represenatives recognised my case my name. Keep calling.... but you would need your employer on the call with you or else they will not help you much. Today i got response to my inquiry email saying "As per the US Consulate, your case has been returned to the Kentucky Consular Center in the United States. You may contact the USCIS office for further information. Please consider this case closed at Chennai Consulate office." So not sure to which number I should call or any email to start with. USCIS has received my case on 29th Jul'11. On 19th Dec'11, I got re-affirmed from USCIS. Not sure what would be the next step. My employer has contacted USCIS and they said case is approved and send to states for further review. Not sure what this states is and what short of further review they want to do here. Ur approved petition details are sent to the consulate. Your employer or lawyer should also receive the copy of re approval from uscis. Once they have that, they need to send that to you. You will have to go in for a re interview (usually it is at the same consulate u went before, in ur case delhi). u need not book another appointment slot by paying hdfc fees, most likely you are called on a specific time. Also it is best to write an email to vfs about this, that you have rcvd re approval & they can also provide you further steps on it. If you dont mind could you please let me know whc service center was ur case pending at vermont / calif or others ?? I am in the same boat, case was sent to uscis in aug 2011, still waiting. You are right, I sent out an email to VFS and they said I can come for re-interview any time before 12 PM. So, I am waiting for the documents which my lawyer has sent out. They never asked any addition documents and never contacted to my employer. My Priority date is March 2011 and I filed green card with current employer in EB2 category with Consular Processing. My I-140 filed in October 2011 and it shows “Initial Review” status till date. Now as I see EB2 is moving so fast, so hoping that in April, my PD will become current. Still now my I-140 is pending, and visa is not stamped yet. what is my chances to get green card. What steps should I take to make it fruitful. Can I ask my employer for make my I-140 as premium?
