Should i apply H4 visa before landing to US? or after join US company ? my salary slip of US company is compulsory for h4 visa interview? please share me your experience... She can try and appear now if you have not yet traveled and reapply after you have worked in the US for a while if it is denied. Remember for the future, a combined H1B and H4 stamping interview is easier for the H4. Link to comment
MurthyIndia_Lawyer Posted August 16, 2011 Report Share Posted August 16, 2011 In most instances, it is best to apply for the H4 visa along with the spouse when s/he applies for the H1-B. If the H1-B was issued recently and you are able to explain as to why you did not apply with spouse, it may be fine to apply for H4 now. If this is not the case, then – in general, it may be better to apply for the H4 visa after the spouse enters the U.S. and starts working pursuant to H1-B status. Since consulates have extensive discretionary powers to cancel an already approved visa, if there is significant time lapse since the H1-B was approved for the spouse and s/he is still in India, there is possibility that the H1-B for the spouse is cancelled if the officer thinks there is any change in circumstances after the H1-B visa was issued.
