Joe.F Posted June 9, 2011 Report Share Posted June 9, 2011 No. The employer needs to file it. There are some categories where a labor certification is not required, e.g., EB2-NIW. In such cases, and ONLY in such cases, the person can file the I-140 on his or her own. Link to comment
