upengan78 Posted March 9, 2011 Report Share Posted March 9, 2011 I am currently working on H1B cap exempt(non profit visa) and another employer would like to apply for cap-subject H1B visa in April 2011. Can you please tell me if the AC21 section 105 H-1B portability provisions, makes me eligible to start working for new employer immediately after my new H1-B is approved or do I need to wait until 1 Oct 2011 to start new employment.
