I am planning to file greencard application through my brother who is a US citizen. I understand that it takes around 10+ years to get the greencard this way. Questions: 1. If I apply the greencard under "Petition for Alien Relative" through my brother, can I apply for a greencard through my employer at later time, around a year after? 2. How long does it take, after the application filing (Petition for Alien Relative) to get it approved so that I can legally stay in US and apply for EAD to work? Can I work/stay in US as soon as the visa priority date becomes current? Thanks in advance for the help. Link to comment
Joe.F Posted July 6, 2011 Report Share Posted July 6, 2011 Having an I-130 doesn't give you any immigration rights. It takes 10+ years to be able to file an I-485 and EAD. Until then, you either would have to have another legal way to stay or you would have to leave the country. Link to comment
