gauravos Posted April 20, 2011 Report Share Posted April 20, 2011 I am on H1 visa and my employer is going to start green card processing for me.My real brother is a US citizen.So can i start my green card processing both ways(employment based and family based)? If yes then will it speed up GC process. I heard that family based GC takes 8-9 years in case of brothers and sisters.Please advice . Link to comment
Joe.F Posted April 21, 2011 Report Share Posted April 21, 2011 The family case would be in Family Category 4, siblings of US citizens, and that has a 10+ year backlog. Employment-based cases may be much faster, depending on where you are from. Link to comment

t75 Posted April 22, 2011 Report Share Posted April 22, 2011 You can have both processing simultaneously. You get no time advantage but can take whichever comes first and have the safety of a backup if the other fails. Link to comment

t75 Posted April 24, 2011 Report Share Posted April 24, 2011 H1B is dual intent so no problems. However, B1/B2 is unlikely to ever be granted since it may not have immigrant intent. You must keep your status on own (H1B) in order to remain in US until priority date. This is easiest processed via employer sponsored extensions. Link to comment
