ganeshiyer2011 Posted April 22, 2011 Report Share Posted April 22, 2011 The Prevailing Wage Determination that my employer obtained for my PERM petition is valid until 6/28. The newspaper advertisements for the recruitment process will be published in May and the earliest date when the PERM can be applied would probably be 6/15. Although the Prevailing Wage Determination would probably be valid at the time of filing the PERM petition, it may not be valid till the time the the PERM petition is adjudicated. Would this be a problem? Is it a requirement that the Prevailing Wage Determination be valid until the PERM is approved or it is sufficient if the PWD is valid at the time of filing and expires shortly thereafter? Attorney_9 Posted May 2, 2011 Report Share Posted May 2, 2011 The PWD needs to be valid at the time of filing the LC OR if the recruitment began within the validity period of the PWD, then you can file at any time during the validity period of that recuritment even if the PWD has expired.
