Attorney_19 Posted July 17, 2011 Report Share Posted July 17, 2011 Yes. It is permissible to be the Beneficiary of both a family-based I-130 petition and an employment-based I-140 petition. The Beneficiary can later choose which case to pursue based on the priority date which becomes current first. Link to comment

However, having an approved I-130 petition for immigrant relative does not help one's H1B extensions. Link to comment
