My I140 approved. was curious, in any case if my H1B extension visa is denied, can i still file my I485 (EB2) even if i'm back in India (when the PD becomes current)? Thanks in advace. Joe.F Posted August 8, 2011 Report Share Posted August 8, 2011 An I-485 is Adjustment of Status, that means you would have to be in a valid status in the US to file it. If you are abroad, you would have to go for Consular Processing. Link to comment
