She moved to H4 6 months back, and now she wants to get back to H1B as her employer wants to get her back. We know that she is not subject to cap. Attorney_13 Posted May 20, 2011 Report Share Posted May 20, 2011 Premium processing will take 15 days to take action on an H1B petition. One can recieve an approval, denial, or another notification such as a request for additional evidence (RFE) within the 15 day window. If the case is not initially approved within the 15 day window, then it may take approximately 2 months to recieve the approval if an RFE is issued.
