vs357190
What happens if the I-485 is approved a few days after I get laid off? Is the employer required to notify USCIS that they are letting me go? Link to comment
Belle
The employer may withdraw the I-140 when you are laid off, but how would they know your I-485 is approved? What you need to do is to come back to employer's HR and offer to work for them indefinitely now that you are approved to work for them. If they refuse to rehire you, you may work for whomever you want. Link to comment
pontevecchio
NO. In most cases if you will continue to work for a new Employer in the same field for some time you will have no problems with naturalization. Link to comment
yourstruly
Can the USCIS cancel the GC if an employee is laid off or fired a few days before or after getting the GC? If its not the employee's mistake in leaving the job (i.e. he got laid off or fired), will the employee still have problems down the line (e.g. naturalization)? Thanks. Link to comment
pontevecchio
Can the USCIS cancel the GC if an employee is laid off or fired a few days before or after getting the GC? Generally not if the person concerned is smart enough to keep a Lawyer onboard. Link to comment
Belle
I think the employer can no longer withdraw I-140 after I-485 is approved. Not 100% sure. Ask a good lawyer. Link to comment
