richmenon Posted August 1, 2022 Report Share Posted August 1, 2022 Hello Summary - I have got GC through employment based option in 2014. I moved back to India in 2016 and gave up GC. I have entered US once in 2022 on B1/B2. I'm thinking of applying for H-1B again, 1 - Will I be exempt from the quota since I have already gone through it once? 2 - If I'm not exempt, can I use the priority date from previous H-1B filing? JoeF Posted August 1, 2022 Report Share Posted August 1, 2022 You are not exempt. You also can not use an earlier PD. All that was gone when you got the GC. You have to start over from scratch. Quote Link to comment
