Bindhu Balakrishnan
I am on H1-B and got my I-140 approved under EB2 category recently . My employer is ready to port EB2 to EB1-C .To do this I need to go to offshore(India) and work as a manager for an year. Is it advisable to travel to offshore immediately after I-140 approval ? Even though the porting is within the same employer, will this impact my EB2 to EB1-C porting as I did not stay in the USA for 180 days after my I-140 approval? After my one year of stay/work in India as a manager ,is it possible to come back to the USA and do the port immediately ? As I did not stay in the USA for 180 days after my I-140 approval , Is it possible to use the EB2’s priority date while porting within the same employer? If porting did not go well and if I wish to change the employer to XYZ , will the 180days be considered as I worked in India for Employer A or it has to be the USA experience ? Thank you in advance !
