H1B withdrawn- Please help!

Recommended Posts

Hi, I worked on H1B for two years (It was a COS from F1 to H1B). I wanted to study more and hence got my F1 approved again through the consular process by traveling back to India.

I have my F1 approved now and will resign this week. My employer is going to withdraw my H1B petition. Can I reuse the remaining H1B years after graduation, and be cap-exempt?

I am confused if it gets revoked or withdrawn and how to use the remainder of the years (4 years) after graduation.

Please help!

Your have worked two years on H1b and then changed to F1.  You will be able to change back to H1b, use your remaining balance years and be cap-exempt.  (Employer withdrawing your H1b will not affect your balance years.)

The employer by law has to inform USCIS that you no longer work there. This is administrative and does not prevent you from using the remainder of the H1 time later.
