Recommended Posts

I had received Permanent Resident card (Green card)  in 2007. Due to family circumstances, I have applied for Travel document in 2008 to stay outside US for 2 years which got expired in 2010. Now If I apply for SB-1 Returning resident Visa what are my chances for approval , please suggest

Pretty much zero.
From https://travel.state.gov/content/travel/en/us-visas/immigrate/returning-resident.html#2

"Under provisions of immigration law, to qualify for returning resident status, you will need to prove to the Consular Officer that you:
Had the status of a lawful permanent resident at the time of departure from the United States;
Departed from the United States with the intention of returning and have not abandoned this intention; anArAre returning to the United States from a temporary visit abroad and, if the stay abroad was protracted, this was caused by reasons beyond your control and for which you were not responsible."

You are staying abroad for about 12 years, and nobody will believe that you couldn't travel in all that time.

Thank you. So I can abandon my GC now and file L1A to travel to US. My Son is US citizen and he can sponsor GC for me. Will there be a problem if I abandon my GC now and apply again for GC through my son in the future (after 3 years from now) ? Please advice
