Concurrent I140 and AOS filing - L1A final year expiry

Hi, 

My I140 and AOS (EB1 - Multinational executive or manager E13) got filed at Texas USCIS concurrently on Nov-18-2021. My L1A (7th year) validity ends by 26-May-2022.  I see processing time for I140 around 9 months to 35 months. I think (not sure), if I140 is pending for approval, I131, I765 and I480 would also be pending. I also understand that there is no premium processing option for I140 for EB1- MEM category at this stage. So if I leave around end of May 2022, is there any risk of AOS getting abandoned? Appreciate quick response !

Under the circumstances you describe, you are allowed to stay till the I-140 is approved and the EAD/AP will not be held up as EB1 is current for India. Talk to your company Law firm directly.
