kthiknar Posted December 8, 2021 Report Share Posted December 8, 2021 I have an approved eb2 i-140 PD march -2011. When the filing dates opened in 10/2020, i filed for my AOS. I had specifically mentioned to my employer to not downgrade. On march i got my biometric appointment and in May i got my EAD with AP. I changed jobs in Aug 2020. What i was not aware of was that the lawyers for my old employer had even though i said no, filed my downgrade to eb3. The i-140 from that is still pending 14+ months and has not moved. Question is "can i request my ex-employer to push the I-140 to premium processing". What are chances of it getting denied( since i am not a current employee). If denied can use my old eb2-i40 and start the perm process again without losing priority date. Quote Link to comment
