rajah.m Posted October 20, 2021 Report Share Posted October 20, 2021 Hi, I am yet to initiate the GC process and one of the employer mentioned that the they already have some approved PWDs and Job ads which are matching with my roles and so they can move on with PERM step. Is this allowed legally? Does the PWD form contain names of the candidate and should it be approved specific to him on the specified roles? Quote Link to comment
Attorney_17 Posted August 16, 2023 Report Share Posted August 16, 2023 The prevailing wage determination form is tied to the sponsored position, not a particular employee. Therefore, as long as the employer is able to demonstrate a bona fide job offer and ability to pay for each sponsored employee, it is permissible for an employer to use an existing prevailing wage determination and advertisements.
