H1b Stamping and Visa extension with a Dismissed DV case

Hi everyone,

I have been charged with DV aggravated assault and the case was dismissed back in March due to lack of evidence. I am on my 3rd H1b, it is due for extension in 2022. I received an offer from a new employer but I am worried if they are going to find out about my record when they apply for my h1b extension next year. 

Has anyone faced a similar situation where they have been arrested and had to explain to their new employer about their criminal history? Will they find out when they do my h1b transfer from my current employer. I am really nervous about changing jobs if it is going to cause an issue with my extension in the future.

Since the case was dismissed, you would be fine in any case. Explore the possibility of expunging the arrest record since the case was dismissed. Once done, private employers will not be able to access the arrest record. Even if they find out, it should not matter. Obviously, mention all information asked for by the employer. Make sure you hang on to the court disposition records.
