Change of Status Issues

Recommended Posts

This week, Murthy Law Firm attorneys will answer questions regarding change of status issues.

If you have a general question, but do not wish to post it in the forum, you may reach a representative at the Murthy Law Firm via eMail. Please allow 3-to-5 business days for a response. Or, if you have case specific questions, please schedule a consultation with a Murthy Law Firm attorney.

Rules for Topic of the Week Threads:

1. Attorney's postings contain general information only and are not a substitute for case-specific legal advice.
2. The attorney will answer only those questions which relate to the main subject. If you have a question on some other issue, please start a new thread in the appropriate forum section.
3. The attorney will not necessarily answer every question posted and may provide a single answer to a group of similar questions.
4. Please do not provide information which would identify any specific company, university or individual.

How long is it typically taking these days to get a biometric done for EB3 'change of status' filing?

Please clarify, I am not sure what you mean by "EB3 change of status".

Change of status filed for someone with an EB3 approval of I-140

I assume you mean an adjustment of status based on a pending AOS, biometrics appointments range drastically from case to case, there are some that filed in the fall of 2020 that are still waiting, but those should be few by this time.

I applied for change of status from F1 OPT to H4 in March 2020 with my husband's previous H1B documents and haven't received any verdict yet. Meanwhile, my husband's H1B got expired in August 2021 and got extended with new H1B. Since USCIS has his previous H1B documents for my case, do I need to send them his updated documents? If not, what are the other options?

Thank you.

Hello,

I do have a quick question: I am in the process of getting my 485(AOS) interview scheduled. I was going thru' my past h1b copies and found that I may be out of status from Feb 8,2007 to May 18,2007. And also I was working with the same company which may have suddenly closed somewhere in 2008 and left to my home country for good in APR, 2009 and came back in SEP 13, 2011 .  Do you think I am out of status and will be denied 485 ?
