BackloggedImmigrant2021 Posted August 17, 2021 Report Share Posted August 17, 2021 Hi Everyone, My current EB2 I-140 has a PD of Dec 2012 taken from my previouis EB2 I-140. I filed for a downgrade to EB3 in Oct 2020, upgraded it to premium in Jun 2021 and got the EB3 I-140 approved in 31 Jun 2021. I find that instead of using the PD from previous EB2 I-140s, USCIS has used my second PERM filing date as my new EB3 I-140 PD. So, from Dec 2012, my PD for EB3 I-140 has moved to Aug 2019. My attorneys (Fragomen) have raised a request by email and phone and are asking me to wait for USCIS to fix the PD issue. Has anyone had this experience and how can we get this fixed as my PD is current for EB3 and I am worried that my AOS application may not get picked up due to the PD mistake. Quote Link to comment
