I have my H1B visa petition approved which will become active from Oct 1st onwards. Alongside my H1B, we filed my spouse's H4 transfer as well. However, she is needing to go to India to care for her parents for 2-3 weeks and plans to be back before Sep 30. She can come back on F2 visa (valid until July 2022 and also my STEM OPT status) My questions 1) what are the risks of doing this travel to India? 2) What happens to her H4 application which has been filed if she leaves the country? 3) What are the steps to be taken as soon as she is back in the US from India? Zodiac System Posted August 10, 2021 Report Share Posted August 10, 2021 (edited) Once your spouse leaves US, her H4 will deemed to be abandoned by USCIS.
