Birth Documentation Issues in the Green Card Process

Recommended Posts

This week, Murthy Law Firm attorneys will answer questions regarding birth documentation in the green card process.

If you have a general question, but do not wish to post it in the forum, you may reach a representative at the Murthy Law Firm via eMail. Please allow 3-to-5 business days for a response. Or, if you have case specific questions, please schedule a consultation with a Murthy Law Firm attorney.

Rules for Topic of the Week Threads:

1. Attorney's postings contain general information only and are not a substitute for case-specific legal advice.
2. The attorney will answer only those questions which relate to the main subject. If you have a question on some other issue, please start a new thread in the appropriate forum section.
3. The attorney will not necessarily answer every question posted and may provide a single answer to a group of similar questions.
4. Please do not provide information which would identify any specific company, university or individual.

Hello I am in the process of filing a green card for my mother (citizen of India). I will be getting a "non availability of birth certificate" letter from the municipal where she was born in India.

My questions are:

1) Since her name changed after marriage, Should I be getting the "non availability of birth certificate" letter in her old name prior to her getting married?

2) If the name has to be old one in the letter, what evidence I can provide to show she is one and the same person? Will a affidavit work?

3) Her wedding invitation card also has her old name, Is that ok to provide this with a affidavit of one and same person (old and new names mentioned)?

Thank you very much in advance!

If a birth certificate was not from around the birth time but obtained after a few years, do we need to submit affidavit along with the GC documentation?

Hello,

When filing I485, is the birth certificate required for the principal applicant only or it is also needed for the dependents as well at the same time?

The non-availability certificate should be addressing the individual as they were named at birth. A marriage certificate can document the married name variation.

If a birth certificate does have just an Initial of the last name, will it cause any issues? Does providing an affidavit is suffice? Or any other suggestions?

Two affidavits and secondary documentation of birth information.

Can you please share the affidavit format for birth certificate

You should be able to use a search engine to find a template.

All applicants need to provide the required documentation, such as evidence of birth.

I have the same question as above. My birth certificate is registered and issued in 2012 (more than 30 years later) by Medical & Health Department per the registration of births and death act 1969.

Are the affidavits and secondary proof necessary?
