ADG Posted June 27, 2021 Report Share Posted June 27, 2021 Hi , I completed my 6 years in US on 30 April 2021 and then I enrolled myself to to a MS course in US which would begin in Fall 2021. I am planning to go to US as F1 student in Fall 2021 and apply for H1b again after completing my MS educttion. My question is , since there is not a gap of 1 year (cooling period) after H1 max date (30 April 2021) and before I join MS as F1 student ( August 2021). Will I be able raise H1 request again immediately after completing my MS or the cooling off period (1 year after H1) will be point of contention? JoeF Posted June 28, 2021 Report Share Posted June 28, 2021 You have to be abroad for at least a year to be able to get a new H1. Entering with an F1 before the year is over would mean you'd have to be abroad again for a year after the studies to get a new H1. Quote Link to comment
