L1B visa extension was applied on 12th Dec 2020, this gave me work authorization of 240 days till August 18th 2021. The same application was upgraded to premium processing and received RFE on 11th June 2021. Parallely, my H1B application was picked and approved that kicks-in from October 1st 2021. The gap between my work auth & H1B visa is roughly 6 weeks. Now, in the event of RFE rejection : 1. Can i somehow close the gap of 6 weeks and do a change of status to H1B from Oct? 2. Can i somehow extend the work auth by 6 weeks ? 3. Will i be able to re-apply the L1B extension and receive another 240 days of work auth? 4. Is there a work around to tackle the situation without leaving the country? 5. If at all possible, How do I convince my HR with H1B approved I do not have to leave the country even if L1B RFE is denied ? Any reference that I can quote ?
