I have an already approved EB2 I-140 and I am working full time on H1-B status with my current employer.. In Oct 2020, I filed for EB3 I-140 downgrade and also concurrently applied for AOS 485. I received my EAD and waiting for my EB3 I-140. I am planning to get added as a derivative (I was never added as a derivative before) under my husband's AOS , which was also applied in Oct 2020. His biometrics are complete and EAD is pending. His EB3 priority date is Feb 2012 and his final action date is going to be current soon in July 1st 2021. So my question is : Once I submit for derivate on July 1st, can I move to another employer immediately using my already approved EB3 EAD (of course by filing 485-J under AC21) and start working for the new employer. is my EAD still valid if I get added as derivative Could you please let me know Quote Link to comment
