Hi all,

I have been arrested for dui with BAC. 0.102(no accident) on june 5th and i have my h1b application process going on and also have a court date coming up,

I hired a lawyer to get the charges down as much as possible, can any help me with questions like

1) will i get an RFE for this

2) what case result would be favorable to me

My company uses an external immigration firm. There was a default question about any arrest in their questionnaire and i have disclosed it but i doubt they looked at it as there was no question in the H1b extension form regarding criminal issues.

i just mentioned the information in the comments section no need to go in detail... Since the case is still open there was no documents to provide but you will have to provide all documents and take care of this issue before applying for AOS and that is a long way for me ..

You were given an RFE because you were found guilty. Did you enter a guilty plea? You would not have received an RFE if the case had been dismissed. If you were charged with DUI with a BAC under 0.102, you should contact an attorney as soon as possible. To help you understand the DUI benefits.
