Travel from India to US on May 22 2021

Hi All,

I am wishing to travel to USA on May 22nd 2021 with my family , I am on H1b and my wife is on H4 , however my son aged about 11 months is a US citizen .

 

Based on the new travel ban from USA against India that would come into force from May 4th 2021 , please can some one let me if I will be allowed to Enter USA on 22nd May 2021.

 

I am enquiring against the below point on the proclamation, please confirm me:

"  any noncitizen who is the parent or legal guardian of a U.S. citizen or lawful permanent resident, provided that the U.S. citizen or lawful permanent resident is unmarried and under the age of 21;"

You are allowed to enter USA with Travel Ban as Your child is US Citizen

I'm planning to travel on May 22nd WITHOUT my US Citizen son. Will I be allowed to enter if I have passport copy / Birth Certificate?

It does not say that the US Citizen son should accompany you.  I guess you may be able to enter with his passport copy/birth certificate.

There is no requirement that the non-US citizen has to  travel with the US citizen child.  IF this was the case, the proclamation would have mentioned this   This is my intepretation, review the exemptions again to be sure.  Yes must carry the original birth certificate of your child, a copy of his US passport.
