Sharjan21 Posted April 30, 2021 Report Share Posted April 30, 2021 Hello, Need your help in understanding if its possible to work from India for a US Employer after H1B Expiry (6 years completed). My Employer has started the PERM process but it started only in my 6th year and I don't think the entire process will be completed by November, when my 6 year gets completed. I have to leave the US but not sure if I can continue to work for the employer and get paid in US dollars when I don't have a valid visa. Help is much appreciated. Quote Link to comment

If you are working from India- you don't need to have H1 visa, but consider paying tax in both countries...consult an actual tax professional. Quote Link to comment
rubixcuber Posted April 30, 2021 Report Share Posted April 30, 2021 No, as soon as your H1B expires, you are not authorized to work for the US employer. My friend was in the same situation last year, his employer was kind enough to keep his employment and send him on LOA to India until his I-140 approved and then he came back once his I-140 approved and applied for H1 extension. Talk to your employer/immigration lawyer for options they can offer. Quote Link to comment
