My wife is working for an international company based in India, which has branches in the USA and Canada (Current work location is India) as Executive Manager for 2 Years. She does have a valid H4 EAD, and my spouse's employer is okay to move her to the US. Can she apply for a GC independently under the EB1 category when she is on H4 EAD? She never had any H1B/L1 visa. What she has is H4 EAD and I140 as my dependent. FYI, I am in the GC queue in EB2. Quote Link to comment
