H4 I-539 application pending approval; Travel to India

Hello,

Please advise on the question below.

Back ground: I have an H4 valid visa stamp until Sep 2021 with my spouse's employer A. My spouses employer name changed from A to B and they filed and extension (Nov 6th 2020) - received approval for H1B I-129 petition whereas H4 I-539 is pending approval upon receipt notice.

Questions:

1. Travelling to India in mid of May 2021 and returning end of June 2021, would that affect the current I-539 case which is pending?

2. Would I face any issues at port of entry in the US?

3. During my stay in India, can I apply for a visa drop box at a US consulate? (currently valid visa stamped until Sep 2020 with employer A of my spouse)

1. In that case the I-539 is IRRelevant to you.

2. You would use your existing H4 visa and your spouse's H1 petition approval to return.

The H4 visa is not Employer specific. It is valid for entry as long as your spouse is in valid H1 status.

As regards the DropBox, you should look up the website.
