I am burnt out in my job and thinking about leaving my job and the US for a few months. When I plan to come back, can a new employer simply file a cap exempt H1B petition for me based on my current H1B, which I can then use to get stamping in India and come back? Quote Link to comment

LeaveMessageH1B Posted March 9, 2021 Report Share Posted March 9, 2021 Be almost close to 72 month- quit job- leave country- get new job apply for ext and i140- get approval- come back most importantly- run it by attorney, we all give our inputs here and most of may not be immigration attorneys.
