Company A applied for my GC (first EB3 and then later EB2 with PD of Dec 2006). I quit my job in Jan 2013. My PD became current in June 2013, since I was not in job then, my I-485 was denied. Company A did NOT revoke my I-140. Now (in Jan 2021) I am on H4-EAD (spouse on H1-B with I-140 approved) and got a job offer from company B with similar job responsibilites as previous job in A. I would like company B to do my H1-B and GC. Question: Am I H1B cap exempt? Quote Link to comment
