CindyLi
I had my H1B approved and programmed to be activated on Oct 1. But then I decided to go to grad school and left my work on Aug 30. My employer filed an H1B revoke right after that day. It's been more than 150 days, and I haven't received the H1B revoke receipt so far, while Google search says it typically takes 30-60days. Haven't been able to fix my F1 status since I am still on H1B according to the USCIS record.. I know they've got a huge backlog right now, but isn't this taking too long? Anyone having a similar issue? Quote Link to comment
JoeF
You don't receive that, the H1 is the employer's petition. When you started grad school you had to file a COS to F1. If you haven't done that you are out of status, and you should discuss your situation with a good immigration lawyer ASAP. Edited February 16, 2021 by JoeF Quote Link to comment
CindyLi
I don't think COS is relevant here, because I have always been on F1. Theoretically, my H1B is never activated (because on Oct 1 I am no longer working for the company) Quote Link to comment
