Regarding Filing GC

Hi,

I had a question and need help. I am currently working full time for Employer A and my company is ready to start initiating PERM application processing, as part of it I was asked to submit documentation, while my previous employer who is a consultancy agreed to downgrade my petition from EB2 to EB3 and filed I140, I485 concurrently as I have approved I140 in EB2 with them with a PD of Feb, 2013. 

Will it be okay to have my GC filed with my current employer (Employer A) while my I140 and I485 filing is still pending with old employer.

 

Please advise.

How long has the AOS been pending and have you informed A about the existing approval?

Last year when dates moved in October 2020, My previous employer filed EB2 to EB3 Downgrade. Its been 3 months from the time my previous employer filed downgraded petition (I140 and I485).

My current employer is aware of EB2 I140 approval which I have, but he is not ware of the downgraded petition which I got filed last year.
