Current H1 expires in 4 mo, but applied for extension. Can I travel in between?

Recommended Posts

Hello everyone,

My current H1 expires in 4 months and I got I-140 approved a month ago, so my employer filed for an extension (premium). Can I travel to India right after I get my H1-Extension approval? or Do I wait until my current H1 expires?

Basically, if I get the extension approval, does the visa officer at Consulate consider a newly approved visa or an old visa that expires in 4 months?

Thanks a lot,

Travel to India and return back before the old visa expires. (Heard that there are lot of issues in stamping due to COVID-19). Show your latest original H1b approval document at immigrations on your way back, so you will get an I-94 stamp based on your new H1b expiry date.  Hope your Passport has enough validity to accommodate the new I-94 date.
