Saip1985 Posted January 12, 2021 Report Share Posted January 12, 2021 I have filed my H1b in 2020 in India . Lottery pickup completed and got RFE . Meantime my F1 visa approved . Now my RFE got resolved . Can you help me , while I am in USA if I get my H1b petition approved , what is the impact on running F1 visa . Can I continue my education(9 months course) then use same H1 or need to go with fresh OPT and H1 ? or need to direct convert in H1 ? . As I am in USA even though I filed H1 in INDIA , am I still need to attend visa interview to get H1? Quote Link to comment
JoeF Posted January 13, 2021 Report Share Posted January 13, 2021 (edited) If the H1 is approved as COS (Change of status) you are in H1 status from the approval date and you'd have to work for the H1 employer. While it is possible to study while on H1 that can only be on the side because you have to fulfill the H1 obligations, i.e., working for the employer.
