saics Posted December 23, 2020 Report Share Posted December 23, 2020 Please guide me if you are aware of the below situation. I-94 expired on July 10th, H1 got denied on 10th Nov with employer A. Employer B filed for H1-transfer on Dec 4th with nunc pro tunc (npt) (due to medical situation) and got approval with I-94 start date from Dec 4th in i797-A As I heard npt approval will provide backdated I-94 to I-94 expiry date(please correct me If this is incorrect). In my case, does USCIS forgives my unauthorized stay of 3 weeks(Nov 10th to Dec 4th)? Quote Link to comment
pontevecchio Posted December 24, 2020 Report Share Posted December 24, 2020 The fact that you got a new I-94 is proof the USCIS does not consider that you had unauthorized stay. You are fine. As a rule they do not back date. Quote Link to comment
