inafix Posted December 8, 2020 Report Share Posted December 8, 2020 DOS gave Favorable Recommendation on 12/01/2020. So my next step was to apply for H1. Company Lawyer says to apply for H1 I need State Medical License. To get State Medical License I need valid work permit which is again H1. So I'm now in a catch-22 or deadlock situation. My J1 expired on June 30th, 2020. I overstayed due to COVID and I was 7 months pregnant. My Husband has GC and his N400 application for citizenship is pending since Jan, 2020 (Biometrics done Feb, 2020). I want to start working ASAP, It's already been 5 months since I signed contract with hospital. Quote Link to comment

Waiver 2020 Posted December 16, 2020 Report Share Posted December 16, 2020 @inafix well I am not sure about your status right now, but my attorney said you have to be in a valid status to convert to another visa/EAD etc. It seems like your best bet is gonna be to wait for your husband to be citizen (if you don't have a valid status, green card spouse can not help you) to file for AOS.
