Both my Indian born parents' H-1 & H4 visa expired almost 20 years ago as well as their Indian passports. I am employed now and want to explore sponsoring them for migrant visas as a US Citizen. Attorney_17 Posted August 23, 2023 Report Share Posted August 23, 2023 A US citizen may sponsor their parents in the immediate relative category. The US citizen will need to file form I-130, petition for alien relative, on behalf of each parent. If the beneficiary parents are abroad, they will then file with the appropriate US consulate for consular processing, to obtain US permanent resident status. If they are inside the US, the beneficiary parents may proceed with adjustment of status, which may also be filed concurrently with form I-130.
