I found an employer who can file a cap exempt petition based on my previous H1 expired recent in September 2020. I get two different opinion on H1 stamping as some of them say I have to go for stamping and return to US before I can work. And others are saying I can work after I receive approval notice and Change of status is filed. My primary question is should I go for stamping to India or I can start working with the approval notice and cos receipt. Edited November 9, 2020 by rubenhardy Quote Link to comment
JoeF Posted November 10, 2020 Report Share Posted November 10, 2020 If the H1 is filed as COS, and the approval notice has a new I-94 at the bottom you can start working. A visa is an entry document only. While in the US you have a status shown on the I-94. That is the only thing that matters in the US. Quote Link to comment
