Can wife, who got GC 3 yrs ago, file I-130 and I-485 while husband is in his 11th month on B1 and awaiting I-539 extension decision?

Can wife, who got GC 3 yrs ago, file I-130 and I-485 concurrently while husband's I-539 extension is pending and he is on B1 in US last 11 mths? Will USCIS accept if pending I-539 is attached along with I-94 that expired at 6 mths. If this can be done & if husband can continue to stay till 485 decision, we want to engage attorney right away. Broader context (if it helps) - marriage is 20+ yrs old, spouses reuniting after a long gap, have a US born teenage child.
