apillai Posted October 25, 2020 Report Share Posted October 25, 2020 HI My Current Employer filed my I-140 in EB2 category and after that i was given a promotion with a title change. My Priority date is in 2013. My company lawyers have come back and told me that i am not eligible for a downgrade as i have surpassed the job that i was in and is in a new title. Job for which filed was Senior Software Engineer , SOC 15-1132 Current title - Software Architect - Current H1B also reflects same SOC code. This is a linear progression and my job responsibilities are 50-60% same as well. Is there any chance for me to downgrade and file in EB3 category?. Any help is appreciated Quote Link to comment
